ARTICULAÇÃO, EXPERIÊNCIA E PRAGMATISMO: APONTAMENTOS PARA A DECISÃO JUDICIAL
Resumo
O objetivo desse artigo fora o de elaborar uma conexão entre os conceitos de articulação e experiência no âmbito da decisão judicial a partir de uma perspectiva pragmática. Essa estratégia teórica atende a dois objetivos: situar o lugar da materialidade da experiência no tocante à decisão judicial e desenvolver uma abordagem sobre a decisão que não se conforme nem a uma perspectiva estritamente objetiva ou subjetiva. A hipótese de pesquisa é a de que, no âmbito da decisão judicial, o universo subjetivo dos atores jurídicos se expressa e se apropria do conhecimento implícito e institucionalizado do campo jurídico para que a sua perspectiva receba uma validação dos outros atores, instaurando assim uma relação circular na qual a divisão entre subjetivo e objetivo perde sua relevância.
