A INTERCEPTAÇÃO DE NAVIOS NO MAR EM VIOLAÇÃO AO PRINCÍPIO DE NON-REFOULEMENT
Resumo
O presente trabalho analisa a prática dos Estados de interceptar embarcações no mar como barreira ao acesso de solicitantes de refúgio quanto às questões relativas ao âmbito de aplicação do princípio de non-refoulement e não rejeição de tais indivíduos nas fronteiras e áreas de acesso, frente ao direito dos Estados soberanos de salvaguardar seu território nacional. Por meio de investigação normativa, doutrinária e jurisprudencial, demonstra-se a violação do princípio pelo impedimento de acesso ao território de destino, inclusive por meio de operações de controle migratório no mar, ainda quando não declarado formalmente o status de refugiado.
