The article discusses the international migration to Brazil, highlighting the flows originating from South American countries in the last decade. It confronts the Brazilian reality with the global context of cross-border migration demonstrating their interrelation and the relevance of critical theory to explain it. It understands the migration phenomenon as irreversible and uncontrollable, although that it can be administered by international and regional organizations, besides States. Finally, it seeks to demonstrate that restrictive laws are incompatibility forward this reality of communication facilities, since its legal effect creates the figure of irregular immigrant, a new worker under the old forms of labor exploitation.
